For these Rules,
"immediate family" means spouse, mother, father, son, daughter, sister and brother regardless of where they reside.
RANDOM DRAW: A random draw will be made on or around December 14, 2007, in Toronto, ON, from all eligible entries received. The selected entrant will be contacted by telephone within three (3) business days of the date of the draw. Odds of winning depend on the number of entries received. To be confirmed a winner the selected entrant must (a) be reached by telephone within three (3) business days of the date of the draw; (b) correctly answer, without mechanical or other assistance, a mathematical skill-testing question to be administered by telephone; (c) be in compliance with these Official Rules; and (d) sign and return within ten (10) business days of the date on the notification, a Declaration of Compliance with these Official Rules and a Release of Liability / Consent to Publicity form, releasing Sponsor, its affiliates, subsidiaries, parent and related companies, advertising or promotional agencies, The Cadillac Fairview Corporation Ltd., and all of their respective directors,
officers, owners, partners, employees, agents, representatives, successors, and assigns (collectively, the “Releasees”) from any liability in connection with this contest or a prize. If the selected entrant cannot be contacted and confirmed a winner as described above, the prize may be forfeited and may be awarded to an alternate entrant. By accepting a prize, winner consents to the use of his/her name, city of residence, voice, statement and photograph or other likeness for any publicity conducted by the Sponsor and/or The Cadillac Fairview Corporation Ltd. in connection with this contest, without further compensation and further consents to providing a photograph for such purpose and/or to having his/her photography taken. RELEASE OF LIABILITY: By entering the Contest, entrants agree that the Releasees will not be responsible for
(a) late, lost, stolen, damaged, incomplete or misdirected entries or entries that are altered, contain false information or are otherwise irregular, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of these Official Rules:
(b) any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including without limitation, printing or advertising errors;
(c) failure of or problems with any equipment or programming associated with or used in the Contest howsoever caused; and
(d) failure of or problems with the Internet or a website at any time howsoever caused;
(e) problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software;
(f) failure, interruption, or delay of any entry or email or post to be transmitted or received or processed whether the failure is the result of technical or human error or for theft, unauthorized access to, destruction or alteration of entries;
(g) traffic congestion on the Internet or at any website or combination;
(h) injury or damage to an entrant's computer or to any other individual's computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize;
(i) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise.
DISPUTE REGARDING IDENTITY OF ENTRANT: If the identity of an entrant is disputed, the entry will be deemed to have been submitted by the "Authorized Account Holder". The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered to be the Authorized Account Holder. Entrant may be required to provide proof that he or she is the Authorized Account Holder of the e-mail address associated with the selected entry.
CONDUCT: By entering, entrants acknowledge that they have read and understood these Rules and agree to abide by them, which are subject to change without prior notice to individual entrants, and all decisions of Sponsor, which shall be final and binding in all matters relating to this Contest and the awarding of a prize. Entrants who have not complied with these Rules are subject to disqualification.
Sponsor reserves the right, in its sole discretion, to disqualify any entrant it finds to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest or the Contest Website; or (c) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. If Sponsor suspects that an entrant has engaged in an unsportsmanlike or disruptive manner, the entrant will be contacted as soon as practicable. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE CONTESTS.
GENERAL: All entries become the exclusive property of the Sponsor, and are subject to verification by Sponsor. Entrants will not be individually contacted except for the selected entrant who will be contacted by telephone as described above. Entries that are late, lost, stolen, damaged, incomplete or misdirected or that are altered, contain false information or are otherwise irregular, will be deemed invalid and void. Sponsor reserves the right to substitute a prize of equal or greater value in the event that the prizes cannot be awarded as described. Prize is non-transferable, must be accepted as awarded by Sponsor, and may not be exchanged by a winner for cash or other substitutes. Sponsor reserves the right in its sole discretion and without prior notice to individual entrants to cancel, close, reinstate, modify or suspend the contest for any reason. The disqualification of an entrant, invalidation of an entry or refusal by an entrant to accept the prize releases and
forever discharges the Sponsor and the other Releasees of all obligations to the entrant. This contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. The contest and these Official Rules shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario. Any dispute shall be adjudicated in the courts sitting in Toronto, Ontario. Copyright in contest materials is owned by Sponsor.
